OVERTIME

Q: Do I have to pay overtime to hourly employees?

A: You bet you do, and there is heck to pay if you don't. The relevant law in question here is a federal law called the Fair Labor Standards Act, passed by Congress in 1938. The law (as periodically amended) sets the minimum wage, requires equal pay for equal work, and mandates overtime for all hours worked in excess of 40 hours a week (unless the employee is in management, then overtime pay is not required.)

Each workweek stands alone; you can't average hours. And you also cannot manipulate the start of the workweek to avoid paying overtime.
